Drunk driver’s car failed to move

Castlebar District Court heard that the defendant was arrested when his car stalled at temporary traffic lights.

The proprietor of a pub in the Castlebar area has been disqualified from driving.

Andrew Foy, 16 The Fairways, Castlebar pleaded guilty at the local district court to drink driving.

Gda John Murphy told the court he was on duty on the Breaffy Road, near Castlebar, at 7am on August 27, 2022. There were temporary traffic lights in place at this location and as the lights turned red, several vehicles stopped. When the lights turned green again, the car at the front of the queue, a silver Mercedes did not move.

Gda Murphy pulled up beside the car and observed the driver slumped over the wheel. The engine of the car was still running. He spoke to the driver Andrew Foy and formed the opinion he was intoxicated. He was arrested and taken to the local station where a sample of his breath gave a reading of 71mg of alcohol per 100ml of breath. The legal limit is 22mg.

Foy has no previous convictions.

Solicitor Gary Mulchrone said his client recently took over the lease of a pub outside Castlebar. On the date in question, he took a chance on driving when he was not fully in the clear.

Judge Vincent Deane imposed a three-year disqualification and a fine of €200.
