Man remains in custody as legal aid dispute rumbles on

The defendant appeared before Castlebar Circuit Criminal Court.

A judge said he does not want to see a situation where a man is in custody for a longer period than a possible sanction imposed by the court.

The 28-year-old Mayo man, who cannot be named in order to protect the identify of his victim, pleaded guilty at Castlebar Circuit Criminal Court earlier this month to a number of charges. He admitted producing a wheel brace and damaging the windows and door of a house. All the offending occurred on December 1, 2025.

The man went to a property and caused damage to the front door, front window, and sitting room windows. He was also charged with producing a wheel brace in the course of a dispute at the residence.

A quantity of MDMA was discovered on the man at a Garda station in the county. He was charged with being intoxicated in a public place and a breach of the peace when he engaged in threatening, abusing and insulting language.

The 28-year-old has been in custody since last January.

Sentencing was originally adjourned to Thursday, October 22, before the escalation of the legal aid dispute saw solicitors withdraw their services from all custody matters. Barrister Brendan McDonagh said there was a “domestic element” to the case.

Judge Eoin Garavan remarked that he does not want to see the man spend more time remanded in custody than any potential sentence imposed by the court. Addressing the man, the judge said he was “concerned” and “wants to ensure there is no danger of you being in custody longer than you should". The judge agreed to adjourn sentencing to November 4 next.
