Judge Marguerite Bolger said she was not satisfied that the balance of convenience or interests of justice favoured or required compelling the Choice Stores outlet to continue to trade against their wishes in Tesco, Bath Road, Poleberry, Co Waterford.

Tesco has been given temporary undertakings from interiors/homewares chain Choice Stores not to shut their outlet, which is within a Tesco superstore at Poleberry in Waterford city, pending hearing of the dispute

On Thursday, Mr Justice Brian Cregan adjourned the matter to next month following undertakings on behalf of Choice to keep the outlet open pending the determination of the proceedings.
